PathBinder Marketplace & Seller Terms

These Marketplace & Seller Terms supplement the Terms of Service and apply to everyone who buys or sells on the PathBinder marketplace. Capitalized terms have the meaning given in the Terms of Service.
1. PathBinder is a venue
PathBinder provides a platform that connects buyers and sellers of trading cards and related collectibles. The contract of sale for any item is directly between the buyer and the seller. Except where we expressly act as a seller, PathBinder is not a party to user transactions, does not take title to items, and does not guarantee the existence, quality, safety, legality, or authenticity of any listing.
2. Seller eligibility
To list items you must (a) be at least 18 years old, (b) maintain a subscription tier that permits selling, and (c) comply with these terms, the Prohibited Items & Acceptable Use Policy, and applicable law. Some item types (for example, sealed product or non-TCG collectibles) and the number of active listings you may maintain depend on your subscription tier, as described in the app.
3. Listings
You are responsible for your listings. You agree that each listing will: accurately describe the item, its condition, grading, and any defects; use images of the actual item or an accurate representation; be an item you own and are able to deliver; and be priced and categorized correctly. You may not list items you do not possess, post misleading content, or manipulate search, prices, or ratings.
4. Fees and commissions
PathBinder charges sellers a commission on each completed sale and may charge a per-transaction processing fee. Current commission rates (which vary by subscription tier) and fees are disclosed in the app at the time you list and at checkout, and may change with notice. The applicable fee is deducted automatically through our payment processor; the remainder is routed to you.
5. Payments and payouts
- Payments are processed by Stripe. To receive payouts you must complete any required Stripe onboarding and provide accurate payout and tax information.
- PathBinder uses a non-custodial payment model (Stripe Connect destination charges). PathBinder does not hold your funds in escrow. Buyer payments are processed and your proceeds are paid out to you on Stripe's standard payout schedule, less applicable fees.
- We do not condition your payout on a buyer "confirming delivery." Buyer protection is handled through the dispute and refund process described in the Refund & Buyer Protection Policy, not by withholding your funds.
- Chargebacks, refunds, and disputes may result in a reversal of amounts previously paid or owed to you, and you authorize us and our payment processor to recover those amounts.
6. Shipping
Sellers are responsible for shipping sold items promptly, securely, and with tracking. You may purchase prepaid shipping labels through the Service (via our shipping provider) or use your own carrier. You agree to provide accurate package and return-address information and to mark orders as shipped with valid tracking. Risk of loss and title pass according to the carrier's terms and applicable law.
7. Taxes
You are solely responsible for determining, collecting, reporting, and remitting any taxes that apply to your sales. Our payment processor may issue tax forms (such as a Form 1099-K) where required and may require tax information before enabling payouts.
8. Order flow and cancellations
Orders progress through statuses such as pending, paid, shipped, completed, and—where applicable—cancelled, disputed, return requested, or refunded. Sellers should fulfill paid orders promptly. If you cannot fulfill an order, cancel it promptly so the buyer can be refunded.
9. Authenticity and intellectual property
You represent that items you list are authentic and lawful to sell. Counterfeit, replica, proxy, bootleg, or infringing items are strictly prohibited (see the Prohibited Items & Acceptable Use Policy). Card names, images, and game trademarks belong to their respective owners; PathBinder is not affiliated with or endorsed by them.
10. Ratings and reviews
Buyers may rate and review transactions. Reviews must be honest and based on a genuine transaction. You may not offer incentives for reviews, post fake reviews, or retaliate against honest feedback.
11. Enforcement
We may remove listings, cancel transactions, withhold or reverse payouts, limit selling privileges, and suspend or terminate accounts for violations of these terms, suspected fraud, or risk to buyers or the platform.
12. Independent relationship
Sellers are independent of PathBinder. Nothing in these terms creates an employment, agency, partnership, or joint-venture relationship between you and PathBinder.
