PathBinder Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and PathBinder LLC ("PathBinder," "we," "us," or "our") governing your use of the PathBinder website at pathbinder.gg and our mobile and web applications (the "Service").

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, Marketplace & Seller Terms, Refund & Buyer Protection Policy, and Prohibited Items & Acceptable Use Policy, each incorporated by reference. If you do not agree, do not use the Service.


1. Eligibility and accounts

You must be at least 18 years old to buy or sell on the Service. Users 13 or older may create an account to browse and maintain a collection only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf. The Service is not available to anyone under 13.

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly at support@pathbinder.gg of any unauthorized use.

2. The Service

PathBinder provides tools to catalog and value trading-card and related collectibles, a card/product scanner, price tracking and alerts, collection organization, a peer-to-peer marketplace, trading tools, and shipping integration. We may add, change, or discontinue features at any time.

3. Subscriptions and billing

PathBinder offers free and paid subscription tiers (e.g., Collector, Enthusiast, Vendor, Shop). Current tiers, prices, features, and limits are shown in the app and may change with notice.

4. Marketplace

Purchases and sales between users are governed by the Marketplace & Seller Terms and Refund & Buyer Protection Policy. PathBinder is a venue that connects buyers and sellers; except as expressly stated, PathBinder is not the buyer or seller of items listed by users and is not a party to those transactions.

5. User content

You retain ownership of content you submit (listings, photos, profile information, messages, ratings, and reviews — "User Content"). You grant PathBinder a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content as needed to operate and promote the Service. You represent that you have the rights to your User Content and that it does not violate law or these Terms.

You must comply with the Prohibited Items & Acceptable Use Policy. We may remove content and suspend or terminate accounts that violate it.

6. Acceptable use

You agree not to: violate any law; infringe others' intellectual property or privacy; post false, misleading, infringing, or objectionable content; list prohibited items; circumvent fees or payment systems; scrape or overload the Service; introduce malware; or attempt to gain unauthorized access. We have zero tolerance for objectionable content and abusive behavior and may act on reports, including removing content, restricting features, and terminating accounts.

7. Intellectual property

The Service, including its software, design, logos, and content (excluding User Content and third-party card imagery/trademarks owned by their respective owners), is owned by PathBinder and protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. Card names, images, and game trademarks are the property of their respective owners; PathBinder is not affiliated with or endorsed by them.

8. Third-party services

The Service integrates third-party services (including Stripe for payments, Shippo for shipping, and others). Your use of those services may be subject to their own terms. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING MARKET PRICES AND VALUATIONS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Price estimates and valuations are informational only and are not guarantees of value or appraisal advice. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATHBINDER AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID PATHBINDER IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless PathBinder from claims, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your transactions with other users, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for any violation of these Terms or for conduct that we reasonably believe harms the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, indemnification, and dispute resolution) survive.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provision below.

14. Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully — it affects your legal rights.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide additional notice. Continued use after changes take effect constitutes acceptance.

16. App store terms

If you download PathBinder from the Apple App Store or Google Play, you also agree to that store's terms, and the applicable store is a third-party beneficiary of these Terms with the right to enforce them. Apple and Google are not responsible for the Service or for support, and any app-store-purchased subscriptions are managed through that store.
